Are there guidelines for how employers may engage in the hiring process?
Employers are prohibited from discriminating against potential employees based on their race, national origin, age, disability, or religious beliefs at any point in the hiring process. Additionally, the privacy of any information that applicants provide to an employer must be maintained an employer—including information provided by the applicant him- or herself or in a background check. In terms of work eligibility for immigrant workers, employers must collect and verify all relevant documentation before hiring an individual.
