Austin Gender Discrimination Attorneys
If you have been the victim of workplace gender discrimination, contact the highly-qualified and compassionate Austin gender discrimination attorneys at The Melton Law Firm today to learn more about your legal rights and what courses of action you may have against those who harmed you. Despite an increasing improvement in workplace gender equality, discrimination on the basis of gender continues to be an issue in some professional settings. Texas was named one of the worst states for gender equality in the workplace in the United States. Women with the same qualifications as men are generally paid less than men for the same work, making seventy-nine cents to the dollar a man makes. When an employer bases hiring, advancement, and firing decisions on the gender of any given employee, they can be held legally accountable.
The Austin gender discrimination attorneys at The Melton Law Firm understand how frustrating it is when wrongful treatment in the workplace prevents you from performing your professional duties. Our attorneys dedicate themselves to defending workers that have been unfairly treated on the basis of their gender. How a Lawyer Can Help
The laws revolving around a gender discrimination lawsuit can be complicated, as both state and federal law apply. Further, the process can be confusing and frustrating because there are certain procedural steps an individual must diligently follow in order to file a gender discrimination lawsuit. In addition, a victim of gender discrimination may face retaliation from their employer or colleagues when they learn of a lawsuit, or when the victim tries to assert themselves. An attorney can help because:
- They understand the law and legal process for filing a gender discrimination lawsuit and can determine what recourse you may have against those who harmed you
- They can identify who may be held liable for the harm you suffered
- They can gather relevant evidence to support your case
- They can help if your employer or colleagues engage in threatening or intimidating behavior because of the lawsuit
In addition, an attorney can speak with other attorneys and professionals to alleviate some pressure from the victim, and help ensure that the victim’s rights are protected. For example, an attorney can ensure that the victim is not bullied into taking a settlement offer for less than they deserve, or agrees to settlement terms with which they are uncomfortable. During a time when you may be feeling a lot of pressure, an attorney can help to protect your rights.

Understanding Gender Discrimination
At The Melton Law Firm, we focus primarily on employment law matters, including gender discrimination. An individual’s gender should not play a role in employment determinations made by their employer. While Texas state law follows the law of at-will employment, meaning that an employer may fire an employee for any reason, it is still illegal under both Texas state law and federal law to discriminate against someone based on their gender. Title VII of the Federal Civil Rights Act prohibits employers from discriminating based on:
- Race
- Color
- Sex
- Religion
- National Origin
- Gender
Additionally, Texas Labor Code Chapter 21 prohibits employer discrimination based on sex or sexual harassment. Importantly, in order for the Texas state law to apply to a gender discrimination case, the employer must have at least 15 employees.
An employer may not take into account a person’s gender when making employment decisions, such as whether:
- An employee is fired or hired
- An employee is promoted
- An employee is given a raise
- An employee is suspended or placed under review
Over the years, we have handled a variety of gender discrimination cases, including those dealing with the above-mentioned issues, and cases involving:
- Sexual harassment
- Employer retaliation
- Hostile working environment
- Discrimination
- Civil rights
- Equal pay
- Overtime
Though a person’s gender should not affect the way they are treated by their employers or coworkers, the following forms of gender discrimination unfortunately occur in some professional settings:
- Derogatory remarks based on an individual’s gender
- Persistent, patterned preference of one gender over another
- Offensive, or otherwise inappropriate, gestures or behavior target to a particular gender group
In addition to state and federal law protecting employees from gender discrimination, they also protect employees from employers or co-workers who retaliate against employees who complain about gender discrimination or sexual harassment.
Gender discrimination is altogether unacceptable and should never be tolerated in the workplace. When an employer instigates discrimination, or fails to protect employees from such abuse, the responsible party may be held legally accountable for their actions.
